This Privacy Policy explains how information about you is collected, used, disclosed and otherwise processed by Jovent Technologies and its subsidiaries and affiliated companies acting as a data controller for the purpose of applicable data protection law (collectively, “we”, “our” or “us”).
Here we describe the privacy practices for our services, including our websites, applications, SMS, APIs, email notifications, buttons, widgets, ads, commerce services, and other covered services that link to these Terms (collectively, the "Services").
Where we need your consent to the collection, use, disclosure, transfer or other processing of your personal information (as described in this Privacy Policy), you provide such consent by accessing and using the Services. If you do not consent to such processing then do not further access or use the Services. Where we need a specific consent to a particular form of processing, such as the collection of information about your location or the use of your information for marketing, we will obtain such consent in the manner described in this Privacy Policy or as otherwise required by law.
We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the “Last Updated” date at the top of this Privacy Policy and, in some cases, we may provide you with additional notice (such as by adding a statement to our homepage or by sending you a notification). We encourage you to review this Privacy Policy whenever you access the Services to stay informed about our information handling practices and the ways you can help protect your privacy. Your continued use of the Services after such changes have been notified will constitute your consent to those changes.
1. Information We Collect
When you use our Services, we collect the following types of information.
Account Information
Personal information is required to create an account on our Services, such as your name, email address, password, telephone number, and in some cases your date of birth and gender. This is the only information you have to provide to create an account with us. Note that the name you use is always public but you can either choose your real name or a pseudonym.
Login Information
We log information about your use of the Services, including your Internet Protocol (“IP”) address, the type of browser you use, access times, pages viewed, number of clicks, and the page you visited before navigating to our Services.
Device Information
We collect information about the computer or mobile device you use to access our Services, or information about certain Jovent tools or devices you use, including the hardware model, MAC address, operating system and version, unique device identifiers and mobile network information.
Network Information
We may collect information about your network, such as information about devices, nodes, configurations, Wi-Fi access point information, connection speeds and network and application performance.
Location Information
We may collect information about the location of your device or tool each time you access or use one of our mobile applications, devices or tools if you have given us your prior permission. For more details, please see “Your Choices” below.
Information Collected by Cookies and Other Tracking Technologies
Cookies and other tracking technologies (such as web beacons, local shared objects, local storage, e-tags, and JavaScript) are used to enhance your experience by allowing us to tailor our content based on your interests and distinguish you from other users of our Services. A cookie is a small file of letters and numbers that we store on your browser or the hard drive of your device. A cookie can contain information, such as a user ID or preferences, which we use to personalize content, track the pages you've visited or to save your password so you do not have to re-enter it each time you visit our Services. Strictly Necessary Cookies.
These are cookies or other tracking mechanisms necessary to make our Services function as intended. They include, for example, cookies that enable you to use a shopping cart.

2. How We Use Information
We use the information we collect for the following purposes.
Provide and Maintain the Services
Using the information we collect, we are able to deliver the Services to you and honor our Terms of Service contract with you. For example, we need to use your information to provide you with your dashboard tracking your cognitive results, activity and other trends; For the Services’ community features, we may use your information to give you customer support, respond to your correspondence.
Improve, Personalize, and Develop the Services
We use the information we collect to improve and personalize the Services and to develop new ones. For example, we use the information to troubleshoot and protect against errors; perform data analysis and testing; conduct research and surveys; and develop new features and Services.
Communicate with You
We use your information when needed to send you Service notifications and respond to you when you contact us. We also use your information to promote new features or products that we think you would be interested in. You can control marketing communications and most Service notifications by using your notification preferences in account settings or via the “Unsubscribe” link in an email.
Cookies
We use cookies and similar technologies for the purposes described above. For more information, please read our Cookie Use statement.
Customer Support
We use the data (which can include your communications) to investigate, respond to and resolve complaints and Service issues (e.g., bugs).
The file containing your personal information will be stored at our offices or on our servers and those of our service providers, which may be located in the U.S. or other countries which may not have a level of data protection law equivalent to that of your country, and your personal information may become subject to the laws of such foreign jurisdictions including those that may grant access to your personal information to the authorities of such foreign jurisdictions. By accessing or using the Services or otherwise providing personal information to us, you consent to the processing and transfer of such personal information in and to the U.S. and other countries in the manner and for the purposes described in this Privacy Policy.
3. How Information Is Shared
We never rent or sell the personal information of our users. We do not share your personal information except in the limited circumstances described below.
Jovent business partners
With Jovent business partners, we may share your personal information with Jovent business partners including distributors, resellers, vendors, consultants, and other service providers in connection with the sale and marketing of products and services offered by Jovent or on behalf of Jovent with your prior permission or where otherwise permitted by applicable law;
In response to a request
In response to a request for information if we believe disclosure is in accordance with any applicable law, regulation or legal process, or as otherwise required by any applicable law, rule or regulation;
Jovent business transactions
Where necessary in connection with, or during negotiations of (including due diligence), any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company, subject to our taking such further steps as may be required by applicable law;
Your consent
With your consent, Jovent also may disclose your personal information to any other third party with your prior consent.
4. How We Store, Process and Protect Your Personal Data
Storage and processing of your personal data
Jovent's global organizational structure requires the global transfer of personal data within the Jovent group of companies. As a result, we may transfer personal data to, and store or process personal data in, countries other than the country in which the personal data originally was collected. Those countries may not have as comprehensive data protection laws as the country from which Jovent initially obtained the personal data. However, Jovent has executed agreements between and among Jovent entities operating in different countries that contain Standard Contractual Clauses (“SCCs”) as defined in the in the E.U. General Data Protection Regulation (“GDPR”), to ensure that adequate safeguards are in place for the protection of personal data. Therefore, when we transfer, store or process personal data in other countries, we will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with the SCCs and this Privacy Statement.
Data Retention
We offer free space to you retain your personal data as part of your individual customer record for a period of five years following any activity on your account. After that time, your record will be inactivated and then deleted in accordance with Jovent’s data retention practices. We may retain personal data associated with orders, quotes, or other official business records for a longer period of time as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
We offer charged space which will larger than free space to you retain your additional data such as data logging records for a period of the contract signed. After the expiration of the contract, the data will be inactivated and then deleted in accordance with Jovent’s data retention practices and shrink the storage to the free space size.
Security
Jovent puts in place appropriate physical, electronic and organizational measures to safeguard and secure your data. These measures follow generally accepted industry standards both during transmission and once it is received. Unfortunately, the transmission of information over the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmission to our website.
Data compromise
In the event that your personal data under our control is compromised, Jovent will investigate the situation and take all steps required by applicable law. This includes notification of the competent data protection authority where applicable, and when appropriate notification of those individuals whose personal data may have been compromised. Jovent may take other steps in accordance with any applicable laws and regulations.
5. Your Rights to Access and Control Your Personal Data
We give you account settings and tools to access and control your personal data, as described below. You have certain rights with respect to your personal data, which your account settings and tools allow you to exercise, as outlined below.
Accessing and Exporting Data
By logging into your account, you can access much of your personal information, including your cognitive activity statistics. Using your account settings, you can also download information in a commonly used file format, including data about your activities and results.
Editing and Deleting Data
By logging into your account and using your account settings, you can change and delete your personal information.
If you choose to delete your account, please note that all data, scores, and information will be permanently deleted, except as noted below.
We retain your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our User Agreement, or fulfill your request to “unsubscribe” from further messages from us. We will retain de-personalized information after your account has been closed.
Note that while most of your information will be deleted within 30 days, it may take up to 90 days to delete all of your information, like data stored in our backup systems.
Location Information
When you first launch any of our mobile applications that collect location information, you will be asked to consent to the application's collection of this information. If you initially consent to our collection of location information, you can subsequently stop the collection of this information at any time by changing the location service setting preferences on your mobile device. If you do so, our mobile applications, or certain features thereof, will no longer function. You may also stop our collection of location information by following the standard uninstall process to remove all of our mobile applications from your device. We may also collect location information when you use certain devices or tools. The owner of the account associated with such devices or tools can control the collection and use of this location information through his or her account settings. If the account owner deactivates the collection of location information, certain features of our devices or tools may no longer function.
Promotional Communications
You may opt out of receiving promotional emails from us by following the instructions in those emails or by emailing us at privacy@jovent.com. If you opt out, we may still send you nonpromotional communications, such as those about your account or our ongoing business relations.
Push Notifications/Alerts
With your consent, we may send push notifications or alerts to your mobile device for updates and communications related to the Services. You can deactivate these messages at any time by changing the notification settings on your mobile device.
6. Information Security
We implement security safeguards designed to protect your data, such as HTTPS. We regularly monitor our systems for possible vulnerabilities and attacks. However, we cannot warrant the security of any information that you send us. There is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

7. Our International Operations and Data Transfers
We operate internationally and may transfer your personal information to our family of companies or to third parties in locations around the world for the purposes described in this privacy policy.
Wherever your personal information is transferred, stored or processed by us, we will take reasonable steps to safeguard the privacy of your personal information. Additionally, when using or disclosing personal information transferred from the European Union, we use standard contractual clauses approved by the European Commission, adopt other means under European Union law for ensuring adequate safeguards, or obtain your consent. Please note that the countries where we operate may have privacy and data protection laws that differ from, and are potentially less protective than, the laws of your country. You agree to this risk when you create a Jovent account, irrespective of which country you live in. If you later wish to withdraw your consent, you can delete your Jovent account as described in the Your Rights To Access and Control Your Personal Data section.
8. Changes to This Policy
From time to time, we may change this Privacy Policy to accommodate new technologies, industry practices, regulatory requirements or for other purposes. We will provide notice to you if these changes are material and, where required by applicable law, we will obtain your consent. Notice may be by email to you at the last email address you provided us, by posting notice of such changes on our Services, or by means of a prominent notice on our home page.
By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
